Welcome to Blurbs! These Terms and Conditions ("Terms") govern your use of our platform, located at blurbs.ai ("Platform"), and any services provided by Blurbs ("we," "us," or "our"). By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

   By accessing, browsing, or using the Platform, you accept and agree to these Terms and our Privacy Policy. We may update these Terms periodically, and continued use of the Platform after any changes constitutes acceptance of the updated Terms.

2. Eligibility

   You must be at least 16 years old to use the Platform. If you are under 16, you are prohibited from accessing or using the Platform, and any information you provide will be deleted.

3. User Accounts

   To access certain features, you may be required to create an account with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and credentials and for all activities under your account.

4. Content on the Platform

   The Platform contains information, comparisons, and other content about MarTech products and services. Blurbs does not guarantee the accuracy, completeness, or usefulness of this content, and it should not be relied upon for decision-making.

   4.1 Content Generated by the AI Bot

   Our AI bot scrapes publicly available content and user-submitted content to generate blurbs and comparisons. If you are a vendor and would like content related to your company removed, please contact us at [email protected], and we will comply with your request promptly.

   Additionally, vendors may request that their content not be used to improve other companies in their vertical category. Please reach out to us if you would like to specify this restriction.

   4.2 User-Generated Content

   Users may submit feedback and other content ("User Content"). By submitting User Content, you grant Blurbs a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, display, and distribute your content on the Platform and in marketing materials. You represent and warrant that you own or have the rights to your content and that it does not infringe on the rights of others.

   Prohibited User Content includes but is not limited to:

   • Offensive, obscene, or defamatory content.
   • Content that violates intellectual property rights.
   • Content intended to mislead or deceive.

   We reserve the right to remove User Content at our discretion.

5. Anonymous Vendor Contact

   We offer a service that allows buyers to contact vendors anonymously. While we facilitate these interactions, we do not guarantee any specific outcomes, responses, or transactions from using this service.

6. Prohibited Activities

   When using the Platform, you agree not to:

   • Impersonate others or misrepresent your affiliation with any person or entity or buyer / vendor role.
   • Attempt to interfere with or disrupt the Platform’s operation.
   • Use any automated means (e.g., bots, scrapers) to access the Platform.
   • Engage in any activity that could damage or undermine the Platform’s reputation.

   We reserve the right to terminate or suspend your account for violating these restrictions.

7. Intellectual Property

   All content on the Platform, including but not limited to text, graphics, logos, software, and AI-generated blurbs, is owned exclusively by Blurbs and is protected by copyright, trademark, and other intellectual property laws. This includes all content created or generated by our AI bot or other proprietary processes.

   You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from Blurbs without our prior written consent.

8. Paid Tiers and Subscriptions

   Our Platform offers both free and paid tiers, with paid tiers providing access to additional content, features, and services that are not available to non-paid users. By subscribing to a paid tier, you agree to the following terms:

   • Subscription Fees: Fees for paid tiers are billed in advance and are non-refundable, except as required by law. Subscription pricing and billing frequency are clearly outlined at the time of purchase and may vary based on the features offered.
   • Automatic Renewal: Paid subscriptions automatically renew at the end of each billing cycle unless canceled. You can cancel your subscription at any time through your account settings. If canceled, access to paid features will continue until the end of the billing period.
   • Content and Feature Availability: Certain content and features are exclusive to specific paid tiers. Blurbs reserves the right to modify or enhance the content available on each tier. We will notify you of any significant changes that could impact your access to content or features.
   • Refunds and Cancellations: We do not generally offer refunds for cancellations that occur during an active billing cycle, but users may reach out to [email protected] to discuss specific cases. Refunds may be granted at our sole discretion.

9. Limitation of Liability for Paid Services

   To the fullest extent permitted by law, our liability for any claim relating to paid tiers or subscription services is limited to the amount paid by the user for the specific service in question during the previous 12 months. Blurbs is not liable for any indirect, incidental, or consequential damages arising from or related to your use of paid services.

10. Disclaimer of Warranties

    The Platform and all content and services provided are on an "AS IS" and "AS AVAILABLE" basis. Blurbs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be uninterrupted, secure, or error-free, nor do we guarantee any specific outcomes from using our services.

    While we strive to provide accurate and up-to-date content, Blurbs does not guarantee the accuracy, completeness, or usefulness of any information provided on the Platform, including paid features. Content is provided 'AS IS,' and we are not responsible for any decisions or outcomes based on this information.

11. Payment Disputes

    If you believe there has been an error in billing, you must notify us within 30 days of the disputed charge. We will review and address any valid concerns, but failure to notify us within this period waives any claim related to the disputed charge.

12. Right to Terminate Access for Breach of Terms

    We reserve the right to suspend or terminate access to any part of the Platform, including paid tiers, for users who violate these Terms. This includes but is not limited to engaging in prohibited activities or misuse of services. No refunds will be issued for accounts terminated due to violations.

13. Modification of Paid Features

    We reserve the right to modify or discontinue any aspect of paid features or content without notice. If significant changes impact your access, we will provide advance notice to minimize disruption. Continued use of the Platform following modifications indicates acceptance of those changes.

14. Indemnification

    You agree to indemnify and hold harmless Blurbs, its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

15. Modifications to the Platform

    We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice.
